1. Acceptance of Terms

By accessing or using the Free-Subdomains service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Free-Subdomains ("we", "our", or "us") regarding your use of the Service. You represent and warrant that you have the legal capacity to enter into this agreement.

2. Description of Service

Free-Subdomains provides users with the ability to create and manage subdomains on domains owned or managed by Free-Subdomains. The Service integrates with Cloudflare for DNS management and security features.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

3. User Accounts

3.1 Account Creation and Responsibility

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

3.2 Account Verification

We may, at our discretion, require you to verify your account through email verification or other means. Failure to complete the verification process may result in limited access to the Service or account suspension.

3.3 One Person, One Account

You may not create multiple accounts for a single individual. We reserve the right to merge or delete duplicate accounts without notice.

4. Acceptable Use

4.1 General Conduct

You agree not to use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

4.2 Prohibited Activities

Prohibited uses include, but are not limited to:

• Hosting, distributing, or linking to illegal content, including but not limited to child sexual abuse material, non-consensual intimate imagery, or content that violates intellectual property rights
• Distributing malware, viruses, or other malicious code
• Phishing or attempting to fraudulently acquire sensitive information
• Spamming or sending unsolicited messages
• Engaging in activities that could disable, overburden, or impair the Service (such as DDoS attacks)
• Interfering with or disrupting the Service or servers or networks connected to the Service
• Attempting to gain unauthorized access to the Service, other accounts, or computer systems
• Scraping, data mining, or otherwise collecting information from the Service without our express written consent
• Using the Service for high-risk activities where failure could lead to death, personal injury, or environmental damage
• Creating subdomains that impersonate another entity or individual
• Using the Service to engage in abusive, harassing, or threatening behavior

4.3 Content Restrictions

You are solely responsible for all content that you upload, post, email, transmit, or otherwise make available via the Service. You agree not to use the Service to host, display, upload, modify, publish, transmit, update, or share any information that:

• Is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
• Promotes illegal activities or conduct
• Infringes upon or violates any third-party rights, including intellectual property rights
• Impersonates any person or entity
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

5. Administration and Enforcement

5.1 Administrative Rights

We reserve the right, but are not obligated, to:

• Monitor and review content and activity on the Service
• Remove or refuse to distribute any content on the Service
• Suspend or terminate users
• Take appropriate legal action against users who violate these Terms

5.2 Account Suspension and Termination

Free-Subdomains administrators may, at their sole discretion and without prior notice, suspend, disable, or delete your account and/or subdomains if:

• You violate these Terms
• You create risk or possible legal exposure for us
• Your account is inactive for an extended period
• We receive a valid complaint regarding your use of the Service
• We are required to do so by law or in response to a legal request
• We believe your subdomain is being used for abusive, fraudulent, or illegal activities
• You engage in any activity that disrupts or interferes with the Service

Upon termination, your right to use the Service will immediately cease, and we may delete or remove your content and account information.

5.3 Appeals Process

If your account or subdomain has been suspended or terminated, you may appeal the decision by contacting our support team. We will review your appeal and respond within a reasonable timeframe. All decisions regarding appeals are final.

6. Intellectual Property

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Free-Subdomains and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

6.2 Your Content

You retain all rights to any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Service.

6.3 DMCA Compliance

We respect the intellectual property rights of others and expect users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide us with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and where it is located on the Service
• Your contact information, including your address, telephone number, and an email address
• A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law
• A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

We reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Free-Subdomains, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• The deletion of, corruption of, or failure to store any content or communications maintained by the Service

In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements

9. Indemnification

You agree to defend, indemnify, and hold harmless Free-Subdomains, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim against Free-Subdomains, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you via email.

11.2 Arbitration

If we cannot resolve a dispute informally, you and Free-Subdomains agree to resolve any claims related to these Terms or the Service through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below.

11.3 Exceptions to Agreement to Arbitrate

Either party may assert claims in small claims court if the claims qualify. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

11.4 No Class Actions

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

12. Changes to Terms

Free-Subdomains reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Entire Agreement

These Terms constitute the entire agreement between you and Free-Subdomains regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

15. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

16. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. We may assign or transfer these Terms, at our sole discretion, without restriction.
